Chapter 7

To be eligible for a filing a Chapter 7 bankruptcy, you must pass the Means Test. This is a formula determines if you are under the median income level for filing a Chapter 7 bankruptcy. If you are eligible, Twin City Attorneys, P.A. would be able to move forward with a Chapter 7, which is also known as the "fresh start" bankruptcy. It is called this because the majority of your unsecured debt may be discharged, allowing you to regain control of your finances.

Chapter 13

If you are not eligible for a Chapter 7 because your income as calculated by the Means Test too high, you still may have the option of seeking relief through a Chapter 13 bankruptcy filing. Chapter 13 is a reorganization of your debts that is designed to help you repay your creditors as much as possible. Many of your debts may be discounted and you have up to 5 years under your Chapter 13 plan to repay your remaining debts. A Chapter 13 is useful if you have developed an arrearage on your mortgage, as the arrears can be paid through the plan. This may be enough to help you save your house from foreclosure.
